Terms of Service

Introduction

Welcome to clarorcia.com (the “Site”).

Clarorcia is owned and operated by Nanchang Xiaofenjia Technology Co., Ltd. (“Company,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) set out the rules that apply when you access or use the Site, including its content, products, checkout functions, customer accounts, tools, and other services offered through Clarorcia (collectively, the “Services”).

By visiting the Site, browsing products, creating or using an account, submitting an order, or otherwise using the Services, you agree to these Terms together with our applicable:

  • Terms of Purchase

  • Privacy Policy

  • Shipping Policy

  • Return & Refund Policy

  • Other notices or policies made available through the Site

If you do not agree with these Terms, you should stop using the Site and Services.

Our online store uses Shopify as part of the ecommerce infrastructure that supports the operation of the Site and the online availability of our products and Services.

Nothing in these Terms is intended to waive, exclude, reduce, or restrict any consumer right that cannot legally be limited under applicable law.

Section 1 — Eligibility and Permitted Use

By using the Site, you represent that you have reached the legal age required to enter into binding transactions in your jurisdiction, or otherwise have the legal capacity necessary to use the Services.

The Site may only be used for lawful purposes.

You must not:

  • Use the Site in connection with unlawful, fraudulent, or unauthorized activity;

  • Breach applicable laws, rules, or regulations;

  • Upload, transmit, or introduce viruses, malware, malicious code, or harmful technologies;

  • Attempt to access accounts, systems, data, or restricted areas without authorization;

  • Disrupt or interfere with the security, availability, or normal operation of the Site;

  • Abuse checkout, payment, promotional, or account functions; or

  • Violate the lawful rights of another individual or organization.

Where reasonably necessary and permitted by law, serious or repeated violations may result in restricted, suspended, or terminated access to the Services.

Section 2 — General Terms of Use

We may limit, suspend, or refuse access to certain Services where reasonably necessary for purposes such as:

  • Protecting Site security;

  • Preventing fraud or unauthorized activity;

  • Complying with legal obligations;

  • Performing maintenance;

  • Preventing misuse; or

  • Addressing other legitimate operational requirements.

Information submitted through the Site may pass through different networks, systems, payment providers, or service providers and may be technically adapted where necessary to deliver the Services.

Unless we or the applicable rights holder have provided authorization, you may not reproduce, duplicate, copy, distribute, resell, commercially exploit, or otherwise misuse a substantial portion of the Site or Services.

Section 3 — Website Information and Accuracy

We make reasonable efforts to ensure that information published on clarorcia.com is accurate and reasonably current.

However, some general Website content may occasionally contain typographical errors, omissions, outdated information, or other non-material inaccuracies.

We may correct, revise, or update Site content when reasonably necessary.

Nothing in this section reduces our obligations concerning:

  • Product descriptions;

  • Pricing information;

  • Accepted orders;

  • Shipping and delivery;

  • Returns;

  • Refunds; or

  • Consumer rights that cannot legally be excluded.

Customers should review the relevant product details and store policies before placing an order.

Section 4 — Product, Service, and Price Changes

Product availability, pricing, promotional offers, and certain Site features may change from time to time.

We may reasonably modify, replace, suspend, or discontinue certain products, services, or Site functionality.

Changes generally will not unlawfully alter rights connected with orders that have already been accepted.

If a material price, product, or listing error occurs, it will be addressed in accordance with our Terms of Purchase and applicable law.

Section 5 — Product Information

Some products may only be available online or may be offered in limited quantities.

We aim to present product information as accurately as reasonably possible, including:

  • Product images;

  • Colors;

  • Materials;

  • Measurements;

  • Descriptions;

  • Features; and

  • Specifications.

Minor visual or physical differences may occur because of factors including:

  • Screen or device settings;

  • Lighting and photography;

  • Reasonable manufacturing variations; or

  • Packaging or product updates.

These reasonable differences do not limit your rights where a product is damaged, defective, incomplete, unsafe, incorrect, or materially different from its stated description.

Applicable return and refund rights are described in our Return & Refund Policy.

Section 6 — Orders and Customer Details

Customers are responsible for ensuring that the information they provide is complete and accurate when:

  • Submitting an order;

  • Providing billing details;

  • Entering a shipping address;

  • Creating or managing an account; or

  • Communicating with customer support.

Orders may be reviewed before they are accepted for fulfillment.

Where reasonably necessary, we may refuse, restrict, or cancel an order because of circumstances such as:

  • Product unavailability;

  • Material pricing or listing mistakes;

  • Incomplete or inaccurate customer information;

  • Payment authorization problems;

  • Suspected fraudulent or unauthorized activity;

  • Shipping restrictions; or

  • Other circumstances that reasonably prevent fulfillment.

Submitting an order does not by itself guarantee that the order will be accepted or fulfilled.

If an order is cancelled after payment has already been collected successfully, the applicable amount will be returned to the original payment method.

For further information, please review our Terms of Purchase.

Section 7 — Payment

The payment methods available for a particular order will be displayed during checkout.

Available payment options may vary depending on factors such as:

  • Customer location;

  • Device type;

  • Payment-provider availability; and

  • Current checkout configuration.

Customers should review the available options before completing an order.

By submitting payment information, you confirm that:

  • The information provided is accurate;

  • You are authorized to use the chosen payment method; and

  • You authorize the relevant payment provider to process the transaction.

Transactions may be processed through Shopify or other independent payment-service providers.

Where payment details are entered directly into a third-party processor's system, Clarorcia may not directly receive or retain complete payment-card information.

Section 8 — Shipping and Delivery

Clarorcia currently ships to addresses within the United States only.

After payment has been confirmed, orders are generally processed within:

Up to 5 business days

Following dispatch, estimated standard delivery within the United States is approximately:

10–20 business days

Our current standard shipping rates are:

FREE Standard Shipping

Orders Below $39.00 USD

$5.99 USD Standard Shipping

The applicable shipping charge will be displayed during checkout before the order is submitted.

Delivery estimates begin after dispatch and do not include the processing period.

Estimated delivery windows are provided for guidance and should not be treated as guaranteed arrival dates.

Delivery may be affected by circumstances such as:

  • Carrier delays or service interruptions;

  • Weather conditions;

  • Public holidays;

  • Transportation disruptions;

  • Local delivery conditions; or

  • Other unexpected logistics events.

Please refer to our Shipping Policy for more complete shipping information.

Section 9 — Order Changes and Cancellations

If you wish to modify or cancel an order, please contact us as quickly as possible.

Requests should generally be submitted before the order enters processing.

Once processing, packing, or shipment preparation has started, we cannot guarantee that an order can still be modified or cancelled.

Orders that have already been dispatched generally cannot be cancelled and may instead need to follow the applicable return procedure.

For complete cancellation terms, please review our Return & Refund Policy.

For assistance, contact:

service@clarorcia.com

Section 10 — Returns and Refunds

Eligible returns, order cancellations, and refunds are subject to our Return & Refund Policy.

Qualifying products may generally be returned within:

14 calendar days after delivery

provided that the applicable eligibility requirements are satisfied.

Our Return & Refund Policy contains information regarding:

  • Return eligibility requirements;

  • Return authorization;

  • How to submit a return request;

  • Authorized return destinations;

  • Return shipping costs;

  • Damaged, defective, incomplete, or incorrect items;

  • Cancellation requests;

  • Restocking fees; and

  • Refund procedures.

Customers should obtain return instructions before sending any product back.

Please do not send a return directly to our registered business address unless our customer service team specifically instructs you to do so.

For eligible returns initiated because of customer preference or other customer-related reasons, the customer is responsible for the applicable return shipping cost.

If a return results from our fulfillment error or a qualifying product defect, the customer will not be responsible for reasonable return shipping costs required to resolve the matter.

We do not charge restocking fees on products that qualify for return under our policy.

Once an approved return has been received and inspected, refunds are generally processed within:

5–10 business days

Additional time may be required by your bank, card issuer, or payment provider before the funds appear in your account.

If a general provision of these Terms conflicts with a more specific term in our Shipping Policy or Return & Refund Policy relating to shipping, cancellations, returns, or refunds, the applicable specific policy will govern to the extent permitted by law.

Section 11 — Damaged, Defective, Missing, or Incorrect Items

If your order arrives:

  • Damaged;

  • Defective;

  • Incomplete;

  • Incorrect; or

  • Materially inconsistent with its description,

please contact:

service@clarorcia.com

To assist us in reviewing the matter, please provide:

  • Your order number;

  • A brief explanation of the issue; and

  • Relevant photographs or videos where appropriate.

After reviewing the available information, we will determine an appropriate resolution based on the circumstances.

Possible resolutions may include:

  • Sending a replacement;

  • Providing a refund;

  • Authorizing a return; or

  • Offering another appropriate solution.

Where the issue was caused by our fulfillment error or a qualifying product defect, the customer will not be responsible for reasonable additional return shipping costs necessary to resolve the issue.

Section 12 — Third-Party Services and Tools

The Site may provide access to tools, payment services, applications, or other functionality supplied by independent third parties.

Those third-party services may be governed by their own:

  • Terms and conditions;

  • Privacy practices;

  • Technical requirements; and

  • Operating rules.

We do not control all aspects of independent third-party services.

Where appropriate, customers should review the relevant provider's terms before using an external service.

Nothing in this section removes responsibilities that we may have under our published policies or applicable consumer-protection law.

Section 13 — External Links

The Site may contain links to websites, services, resources, or platforms operated by independent third parties.

We do not control such external sites and are not responsible for their:

  • Content;

  • Security measures;

  • Privacy practices;

  • Availability; or

  • Independently provided goods or services.

If you visit an external website, you should review its applicable policies and terms before submitting personal information or completing a transaction.

The presence of a link on our Site does not necessarily mean that we endorse the third-party website or its content.

Section 14 — User Content

Where the Site allows customers to submit reviews, comments, photographs, feedback, or other content, you are responsible for ensuring that you have the necessary rights or authorization to provide that material.

You must not submit content that is:

  • Illegal;

  • Fraudulent;

  • Defamatory;

  • Abusive;

  • Malicious;

  • Infringing;

  • Knowingly misleading; or

  • Otherwise prohibited under applicable law.

We may remove or restrict access to user-submitted content where reasonably necessary to protect customers, third parties, the Site, or our business.

Section 15 — Privacy

The collection, processing, retention, disclosure, and use of personal information are described in our Privacy Policy.

Please review that policy for further information about:

  • Types of personal information we may collect;

  • Purposes for which information may be used;

  • Circumstances in which information may be disclosed;

  • Cookies and similar technologies;

  • Available privacy rights;

  • Marketing preferences;

  • Data-sharing options; and

  • Other privacy-related practices.

Privacy requests should be submitted using the procedures described in our Privacy Policy.

Section 16 — Intellectual Property Rights

Unless otherwise indicated, the Site and its content—including text, graphics, product images, logos, icons, layouts, designs, software, and other materials—are owned by, licensed to, or otherwise lawfully used by Clarorcia or Nanchang Xiaofenjia Technology Co., Ltd.

You may use the Site for lawful personal and non-commercial shopping purposes.

Without authorization from us or the applicable rights holder, you may not:

  • Reproduce;

  • Copy;

  • Modify;

  • Distribute;

  • Publish;

  • Sell;

  • License;

  • Commercially exploit; or

  • Create derivative works from

protected Site materials.

Names, trademarks, logos, and other intellectual property belonging to third parties remain the property of their respective owners.

Section 17 — Website Availability

We aim to maintain a reliable and secure online shopping environment.

However, the Site may occasionally be affected by:

  • Scheduled or emergency maintenance;

  • Technical interruptions;

  • Service delays;

  • Errors; or

  • Other operational issues.

To the extent permitted by applicable law, general Site functionality is provided on an “as available” basis.

Nothing in this section limits rights relating to accepted orders, eligible refunds, defective products, or mandatory consumer protections.

Section 18 — Disclaimer

To the extent permitted by applicable law, we do not guarantee that access to the Site will always be uninterrupted, continuous, or completely free of technical errors.

Nothing in these Terms excludes or restricts:

  • Statutory warranties;

  • Consumer guarantees;

  • Product-safety obligations;

  • Mandatory legal remedies; or

  • Other rights that cannot lawfully be waived or limited.

Section 19 — Limitation of Liability

To the fullest extent permitted by applicable law, Nanchang Xiaofenjia Technology Co., Ltd., together with applicable service providers and representatives, will not be liable for indirect, incidental, special, or consequential losses arising solely from access to, use of, or inability to access the Site where such liability may legally be limited.

Nothing in these Terms excludes or restricts liability that cannot legally be excluded or limited.

This section does not limit customer rights relating to:

  • Damaged or defective products;

  • Products that are materially misdescribed;

  • Incorrect orders;

  • Eligible refunds;

  • Fraud;

  • Willful misconduct;

  • Mandatory consumer protections; or

  • Other rights or liabilities that cannot legally be waived.

Section 20 — Indemnification

To the extent permitted by applicable law, you agree to be responsible for reasonable losses, claims, liabilities, or costs directly resulting from:

  • Your unlawful use of the Site;

  • A material breach of these Terms; or

  • Your infringement of another person's lawful rights.

This provision does not require you to compensate us for losses caused by our own unlawful conduct, negligence, breach of these Terms, or failure to comply with applicable law.

Section 21 — Restriction, Suspension, or Termination

We may restrict, suspend, or terminate access to the Site where reasonably necessary, including in cases involving:

  • Fraud or suspected fraud;

  • Unlawful activity;

  • Security threats;

  • Serious misuse of the Site; or

  • Material breaches of these Terms.

A restriction or termination of Site access does not eliminate rights or obligations that arose beforehand, including those relating to:

  • Accepted orders;

  • Payments;

  • Returns;

  • Refunds; or

  • Mandatory consumer rights.

Section 22 — Severability

If any provision of these Terms is found by a competent court or authority to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the greatest extent permitted by applicable law.

The remaining provisions will continue to apply to the extent that they remain legally enforceable.

Section 23 — Governing Law and Consumer Protections

These Terms and your use of clarorcia.com are subject to applicable law.

Nothing in these Terms is intended to remove, reduce, or restrict mandatory consumer protections available to you under applicable law.

Any dispute relating to these Terms will be handled in accordance with the laws and jurisdictional requirements that legally apply to the relevant parties and circumstances.

Section 24 — Updates to These Terms

We may revise these Terms periodically to reflect changes involving:

  • The Site or Services;

  • Our business practices;

  • Technology;

  • Operational requirements; or

  • Applicable legal or regulatory obligations.

The current version will be published on the Site.

When appropriate, the Last Updated date at the top of these Terms will also be revised.

Updated Terms generally take effect from the date they are published or otherwise stated to become effective and will not unlawfully change rights attached to orders accepted before that date.
